Drug Workplace Policy

Effective counter-drug programmes in the workplace – not unlike those in schools, writes John Franklin-Webb, Principal Director, GIS.

The need to establish a clear drug policy is exactly the same; however, some differences need to be addressed. The focus on consultation with line management, and the unions is crucial. In our experience the unions have fully supported pro-active counter drug measures in support of a ‘safer working environment’ for their members.

References to the policy need to be included in contracts of employment or as an addendum to existing contracts, health and safety policies and risk assessments. Search policies and subsequent disciplinary procedures in the event of drugs being found also need to be firmly established. Drug awareness training for managers; what to look for where to look, recognition of drug related paraphernalia, debris and safe legal handling of items found are all important factors.

Drug misuse is not the exclusive domain of the night economy and licensed trade, people do not just stop taking drugs Monday to Friday and start again on Friday night, drug misuse rarely complies with such discipline. In any event if this was to be the case those that have participated in drug misuse over the weekend will still have residue in their system during the working week and this will impact on performance.

Large corporations are particularly attractive to dealers as a target market and therefore fully exploited. In some cases drug orders are placed in advance say on Tuesday for delivery before the weekend. Section 8 of the 1971 Drugs Misuse Act clearly states that if those who are concerned with the management of a premises "knowingly" allows the sale of illicit drugs they will be held legally responsible. It is possible that section 8 is going to be repealed as under the new "Anti Social Behaviour Act 2003" and "Class A Drug House Closure" powers will suffice in most cases. Further threat to business is the fact that a drug habit needs funding and this can lead to corporate fraud, theft and those using being compromised by the sale of confidential information. It is important that we understand that illegal drug misuse and dealing is still in the minority and all employers have an obligation to ensure it remains that way while protecting their employees, business interests and corporate integrity.
